The small print.
These are the Terms and Conditions ("Terms") on which Jamaica Yard agrees to hire its premises to hirers ("you" and "your") for functions and events. Please read these Terms carefully as, by placing a booking with us, you will be entering into a contract on the basis of the Terms.
1. OWNERSHIP & DEFINITIONS
1.1 This document sets out the Event Terms & Conditions at Jamaica Yard, which is located at 3 Jamaica Street, Edinburgh, EH3 6HH (“the premises”).
1.2. The following definitions will apply throughout these Terms. The “Client” means the person primarily responsible for the submission to the provider of the booking confirmation. “Attendees" means any person attending the Event; "Booking" means your booking of the venue and associated facilities; "Charges" means all charges payable by you in connection with the Contract; "Contract" means the agreement incorporating these Terms; "Event" means your event, function or conference; "The Spaces" means the room(s) or location(s) specified in the Contract; "Hire Period" means the period for which you have booked the Spaces; "Services" means any services we agree to provide in connection with your Booking; and "Venue" means the property of Jamaica Yard.
1.3. Jamaica Yard is a division of Hive Spaces Limited, (Registered Office: 19 Rutland Square, Edinburgh EH1 2BB; CompanyRegistration Number: SC683903).
2. EVENT PAYMENT
2.1. A deposit of 50% of the venue hire fee is required to confirm a Booking of the venue.
2.2. All deposits are non-refundable and, in the event of complete cancellation of the Booking, the deposit will act as a cancellation fee.
3. LIABILITY
3.1. The Client shall pay for any loss or damage to any part of the Premises, or to any fixtures, fittings and equipment which are caused by the Client or Guests. Jamaica Yard will not be held responsible for damage to any article brought onto the Premises. Any loss or damage on the Premises should be reported immediately to Jamaica Yard.
3.2. The Client is responsible for the behaviour and actions of their Guests while they are on the Premises. Inappropriate behaviour may result in your Booking being stopped early or cancelled.
3.3. Clients are reminded that we wish everyone to enjoy the facilities on the Premises; however, as there is an access road close by, children need to be supervised at all times. Flooring throughout and outside the Premises is uneven. The Provider accepts no responsibility for any injury caused as a result of uneven flooring inside or outside the Premises.
3.4 We have a 7 day lost and found policy, which means we can only keep an item found for that amount of time. It is the Client’s responsibility to check for all personal belongings on the premises before departure. Any items found will be kept at the Premises and can be collected within that time frame or will have to be sent to the Client at their expense.
4. AMENDMENTS AND CANCELLATIONS
4.1. Jamaica Yard reserves the right to cancel the Booking under circumstances beyond its control including without prejudice the foregoing generality acts of god, war, terrorism, pandemic or industrial dispute.
4.2. Jamaica Yard will endeavour to accommodate all reasonable changes to the Booking requested by the Client prior to the event. Change requests must be confirmed in writing by the Client. Jamaica Yard will advise the Client of any applicable changes to the Event Charges as a consequence of the Client’s change request.
5. CONDUCT OF CLIENT AND GUESTS
5.1 The Client and guests of Jamaica Yard are required to comply with the guidelines set out in the General Conduct Guidelines below.
5.2. The Provider reserves the right to request any Guest to leave if the Guest is behaving in a dangerous, unreasonable or disruptive manner. In such circumstances the Provider will be under no liability to the Client or Guests in respect to any refund of the price or compensation for any costs or damages, which may be incurred by the Client or Guests.
6. OTHER IMPORTANT CONDITIONS
6.1. Jamaica Yard reserves the right to update these terms and conditions. We will give written notice of any changes.
6.2. This Agreement shall be governed and construed in accordance with Scots Law and each party agrees to submit to the non-exclusive jurisdiction of the Scottish Courts as regards any claim or matter arising.
6.3. The capacity of the venue is a maximum of 60 people and the Client is responsible to ensure that this capacity is not exceeded at any point. If the capacity is exceeded, Jamaica Yard and its staff reserve the right to call an end to the Event in question.
6.4. Due to the Venue’s architecture and heritage, Jamaica Yard cannot guarantee access for disabled guests.
General Conduct Guidelines
1. GENERAL CONDUCT
The Client and their guests shall conduct themselves with decency and courtesy at all times. The Client and their guests should treat other guests and staff with respect and should not carry on any activity which infringes any rights of Jamaica Yard or the Company. Such conduct may include inappropriate (including excessive bad language, shouting or indecent behaviour), violent, or abusive behaviour, consumption of excessive alcohol, or the disclosure or communication of confidential information. Jamaica Yard reserves its right to order the immediate withdrawal from the premises of any guest who violates this Conduct code.
2. ENTERING & LEAVING
Members should enter and leave Jamaica Yard quietly in consideration of the neighbours.
3. DRUGS AND ILLEGAL SUBSTANCES
Non-prescription drugs are not permitted on the premises at any time. Members should not enter the premises whilst under the influence of non-prescription drugs or any other illegal substance.
6. SMOKING
Smoking (including e-cigarettes and vapes) is not permitted inside Jamaica Yard premises at any time. Jamaica Yard may designate certain exterior areas of the premises where smoking is permitted which will be notified to the Client and may change from time to time.
7. ACCIDENTS AND INJURIES AND USE OF FACILITIES
Should a member or guest have an accident or suffer any injury in Jamaica Yard, this should be reported as soon as possible to a member of staff. Members should not use the facilities/Yard Athletic if they feel unwell or have any health issues without first notifying an appropriate member of staff.
8. SPECIAL NEEDS / REQUIREMENTS
Members should notify Jamaica Yard of any disabilities or known allergies or dietary requirements relating to themselves or their guests. Unfortunately, owing to the Venue’s architecture and heritage, Jamaica Yard cannot guarantee access for disabled guests.
